Editorial Julio 2020 – La nueva normalidad –

 Distinguidos lectores:

 El mundo ha vivido un cuatrimestre muy duro por la pandemia. Muchos países, como el Ecuador, han tenido que tomar decisiones drásticas, con aciertos y desaciertos, para salvaguardar la salud de sus ciudadanos. Entre esas medidas de cuarentena, ha conllevado a una desaceleración económica global, la cual aumentará la cantidad de desempleo y trabajo informal.

Algunas ciudades importantes, como Guayaquil, están entrando en una nueva etapa de reactivación. Sin embargo, esto no significa la misma normalidad previo la pandemia. Las industrias y comercios formales han demostrado su capacidad de adaptase a la modalidad de teletrabajo como también tomar medidas de precaución para mitigar el contagio del COVID-19 y mantener las actividades productivas, necesarias para el bienestar nacional. Todavía queda un camino largo, el cual solo con el trabajo mancomunado del sector empleador, trabajador y el gobierno, servirá para superar los obstáculos de forma ordenada y adecuadamente.  

Lamentablemente, la Ley de Apoyo Humanitario no ha podido ser una norma que cubra muchos aspectos importantes para una reactivación económica del país. Si bien hay algunas normas positivas, distan mucho de un cambio necesario y estructural que ayude al país a corto y mediano plazo. Como gremio encargado de la presidencia del Comité Empresarial Ecuatoriano hemos hecho constante solicitudes a las autoridades tanto para generar un marco regulatorio adecuado a las circunstancias que estamos viviendo, como también como proponentes, junto a federaciones empresariales, de una acción de inconstitucionalidad contra las disposiciones de dicha Ley relacionadas a la causal de fuerza mayor o caso fortuito como justificación para terminar un contrato que generan inseguridad jurídica.
